Abstract

Today librarians, archivists, and other information professionals can hardly escape the conundrum of intellectual property law and licensing. As our work increasingly encompasses copyright-intensive programs and projects, questions arise about topics such as fair use, e-media, digitization, licensing, and, of course, risk. During the height of the pandemic, these long-discussed issues about modern access to library collections came to the forefront. Fortunately, there is a careful balance outlined in the law between copyright and access. And there are several exceptions that can serve as the beginning of robust policy that utilizes these exceptions to increase access. Knowledge of these exceptions can help mitigate risk for institutions. Join Kyle K. Kyle K. Courtney, both lawyer and librarian, is the Copyright Advisor at Harvard University. Working out of the Harvard Library Office for Scholarly Communication, he works to establish a culture of shared understanding of copyright law and related legal issues within the Harvard community. His Copyright First Responders program is in its 8th year, having spread from its origins at Harvard to 10 states across the U.S. He continues to teach first year legal research workshops as part of Harvard Law School's Legal Research & Writing Program, and has taught Cyberlaw: Privacy, Ethics, and Digital Rights for the master's and PhD Cybersecurity program for over a decade.
